Acceptable Use Policy

RxMDShop, LLC ("RxMDShop," "we," "our," or "us") is a technology platform that provides DTC health and wellness brands with tools to operate online stores and connect with independent third-party telehealth providers and pharmacies. This Acceptable Use Policy ("AUP") describes activities that are prohibited in connection with your use of the Services.
This AUP supplements our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms. In the event of a conflict between this AUP and the Terms, this AUP prevails to the extent of the conflict.
We may, at any time and without notice, remove content, suspend or terminate accounts, restrict access to features, or take other action if we believe you have violated this AUP, applicable law, or our Terms. RxMDShop's determination of whether a violation has occurred is final and binding.
1. General prohibitions
You may not use the Services to engage in, facilitate, or promote any of the following:
Illegal or fraudulent activity
- Any activity that violates federal, state, local, or international law
- Fraud, deception, or misrepresentation, including unsubstantiated health, efficacy, or pricing claims
- Money laundering, sanctions evasion, or transactions with sanctioned persons or countries
- Tax evasion or unauthorized financial activity
Pharmacy, prescribing, and product violations
- Selling, marketing, or facilitating the sale of any product or service in violation of the Federal Food, Drug, and Cosmetic Act, the Controlled Substances Act, the Ryan Haight Online Pharmacy Consumer Protection Act, the Drug Supply Chain Security Act, or applicable state pharmacy and telehealth laws
- Operating without all required state pharmacy, prescriber, and telehealth licenses, registrations, and DEA registrations
- Issuing prescriptions without a legally sufficient practitioner-patient relationship under applicable state and federal law
- Dispensing or facilitating the dispensing of medications outside the scope of an authorized prescription
- Selling or marketing medications, devices, or supplements that are not lawfully marketed in the destination jurisdiction
- Mislabeling, adulterating, or repackaging products in violation of law
- Selling counterfeit, recalled, expired, or stolen products
- Bypassing, attempting to bypass, or facilitating evasion of clinical safety controls, intake screening, lab review, or contraindication checks
- Marketing or selling controlled substances except in full compliance with federal and state law
- Selling cannabis, cannabis products, or kratom in violation of applicable law
- Selling weight-loss, sexual-health, mental-health, hormonal, fertility, or pediatric products in a manner that violates state laws specific to those categories
Marketing and consumer-protection violations
- Making unauthorized therapeutic, disease-prevention, or disease-treatment claims, including for products that are not approved drugs
- Spam, sending unsolicited commercial messages, or violating CAN-SPAM, TCPA, or state telemarketing or autodialer rules
- Using deceptive subject lines, pricing, dark patterns, false urgency, or misleading "before and after" claims
- Failing to provide accurate, conspicuous public-facing contact information, refund and shipping policies, telehealth consents, and other consumer disclosures
- Using endorsements, testimonials, or influencer marketing in violation of FTC guides
- Targeting minors with health products
Patient and PHI handling
- Posting, uploading, or transmitting Protected Health Information (PHI), Personally Identifiable Information (PII), or sensitive personal information outside the secure channels provided by the Services
- Using PHI for any purpose not permitted by HIPAA, the Business Associate Agreement, applicable state law, or the patient's authorization
- Re-identifying or attempting to re-identify any de-identified data
- Selling PHI
Self-harm, child safety, and harmful content
- Promoting, glorifying, or facilitating self-harm, suicide, eating disorders, or substance abuse
- Exploiting or endangering children, including any content that sexualizes minors
- Hate speech, harassment, threats, or content that incites violence or discrimination based on protected characteristics
- Content that promotes terrorism or violent extremism
Security and platform abuse
- Uploading or transmitting malware, viruses, ransomware, worms, or other malicious code
- Phishing or hosting phishing pages
- Unauthorized scanning, probing, vulnerability testing, or denial-of-service attacks
- Reverse-engineering, decompiling, or attempting to extract source code from the Services
- Bypassing technical or contractual restrictions, including processing orders outside RxMDShop checkout flows
- Scraping, crawling, or harvesting data from the Services without our prior written consent
- Sharing account credentials with unauthorized users or with users who have been suspended
Intellectual property and other prohibited categories
- Infringing copyright, trademark, trade secret, patent, publicity, privacy, or other rights
- Adult content, pornography, or escort services
- Gambling, lotteries, or sweepstakes in violation of law
- Multi-level marketing schemes that constitute illegal pyramid or chain-letter schemes
- Weapons, firearms, ammunition, explosives, or related accessories
- Tobacco products, vaping products, or alcoholic beverages, except where RxMDShop has provided express written authorization and you comply with all applicable laws
- Activities targeted by U.S. or foreign government export-control or sanctions regimes
2. Compliance obligations
You must comply with all applicable laws and regulations governing the processing, use, or disclosure of personal information and PHI, including HIPAA, state consumer-health-data laws, and the rules of any state pharmacy or medical board with jurisdiction over your business.
You must maintain reasonable security practices, including secure password management, prompt off-boarding of departed personnel, and prompt notification to RxMDShop of any suspected security incident affecting the Services.
3. Reporting violations
If you believe someone is violating this AUP, please report it to [ABUSE EMAIL] with the relevant details. We may investigate, but we are not obligated to act on every report.
4. Enforcement
We may, in our sole discretion and without prior notice:
- Investigate suspected violations
- Remove or restrict access to content
- Suspend or terminate accounts
- Withhold payouts pending investigation
- Report violations to law enforcement, regulators, or affected third parties
- Pursue any other remedy available at law or in equity
We may charge reasonable fees for resources expended addressing violations, including chargebacks and regulatory inquiries.
5. Modifications
We may modify this AUP at any time by posting an updated version. Continued use after the effective date constitutes acceptance.
